"Alfalfa" (alfalfa-romeo)

Mrs. Alfalfa was involved in an accident earlier today. One passenger in the other car went to the hospital complaining about ba ck pain. Everyone else is okay.
There was a construction vehicle parked in the red zone right at the corner of an intersection, so my wife could not see traffic going through the 2 way stop. Got hit by an S10. The police didn’t issue her a citation and said they would “be dealing with the construction company”, and took pics of the rig before telling the people to move it.
This is basically all I know of the damage, they were already loading on a flatbed by the time I got there. The driver of the S10 was a very kindly old man and handled everything really well. My wife felt horrible that the passenger was injured and already struggles with anxiety. I’d say she was just shy of a full-fledged panic attack when she called me.
She requested I also include this pic to show off how well our good boy helped her feel better at the scene.
As for the f ate of the Hyundai, without being able to really inspect the damage I won’t be surprised either way if they decide to fix or total it.

Hopefully your wife didn’t admit fault, even if she was at fault.

I don’t think she did. So far everyone seems pretty keen on going after the construction company. There were multiple witnesses who all agreed that she could not see with that truck parked where it was.

I’d guess it’s totaled since the damage is going all the way down the side. Hopefully some car shopping fun for you!

Yeah probably. We've already done a little window shopping today. What sucks is that I just bought a car, so we'll probably have to finance.

How much does this really matter? Seems like someone’s insurance will pay regardless, so it’s at most the deductible (and maybe future rate increases) on the line . I can understand why the insurance company doesn’t want anyone to admit fault, but it doesn’t seem like it should be at all catastrophic for the driver (though still presumably to be avoided if possible ).

The deductible and rate increases can add up to a lot of money though. No point shelling it out if you don’t have to.

While I can see how an attorney or a claims adjuster could TRY to use an admission of “guilt,” from a practical and legal perspective I don’t see how it would stick.
Let’s say for instance I was in a crash and I was dumb and said “I’m sorry” and the adjuster tried to assign blame based solely on that. My argument would be that I’m not expert. How does one flippant statement determine fault in an accident? It does not.
But regardless of my statement, people should keep their mouth shut in the event of a crash. I HATE it when people try to assign blame right then and there. No matter* what you guys say it won’t change the outcome. Someone backed into my Mercedes one time in a parking lot, but their insurance did not find him at fault. Why? Because nine times out of ten the person in the back ran into the car. And my insurance was too much of a pansy to use the evidence (lack of damage, statement by the driver) to actually get them to pay for it. Which pissed me off to no end.

Love the pup pic. My wife deals with some of that as well... she got her first speeding ticket (school zone) a few weeks ago and was spun up pretty bad for a few days...

I'm not sure it matters much if the police on the scene are blaming the construction truck owner for creating a hazard

That dog is adorable! Sucks about the car, but I'm sure things will work out. Sounds like the construction company is definitely going to have to take the blame.

But what you think doesn’t matter. I highly doubt an adjuster is going to try to lay blame based solely on the fact that you said sorry. And if they did, they shouldn’t be an adjuster because an attorney would rip through that argument in a second.

holy crap that is a lot of deductible! Makes it sound like I would rather have no insurance at all...(aside from liability of course, because you know the law and people/property damage stuff is expensive)

The c ar was worth just a little more than what made me comfortable doing liability only, the 2k deductible made me feel a little better and didn't cost too much more.
